Bluesemi Research & Development Private Limited (hereinafter referred to as Company), a company registered under the Laws of India is a manufacturer and service provider of "EYVA®" including through its mobile application, web based application, web page, mobile web page (hereinafter collectively referred to as "website") or its contents
What is Cancellation, Return, Exchange and Refund Policy?
This Cancellation, Return, Exchange and Refund Policy shall apply to the user of this mobile application, web-based application, web page, mobile web page (hereinafter collectively referred to as "website") or its contents and this policy, together with Terms and of Company's website, speaks of terms and conditions related to the cancellation of orders, returns of Eyva, exchange of Eyva and Refund of cancelled orders.
Warranty Terms & Conditions
THIS WARRANTY DOES NOT COVER
Defects or damage resulting from the use of the Product in conjunction or connection with accessories, products not approved by EYVA.
Damage or inoperability caused by repair work performed by the end user or any unauthorized repair center.
Any software programs, whether provided with the product or installed subsequently.
DAMAGE: This warranty does not cover any physical and/or electrical damage resulting from, but not limited to:
- Accident/neglect
- Misuse
- Abuse
- Malicious destruction
- Water or splash or dust damage
- Ordinary wear and tear
- Acts of nature
- The temporary or permanent affixing of any items supplied or not supplied by the manufacturer with any adhesive, fastener or the like.
- Over charging, use of batteries, power supplies or any other sources of power not recommended by the manufacturer.
- Any physical defect or damage resulting from improper testing, operation, maintenance, installation, service, or adjustment caused not furnished or approved by EYVA.
- Damage, fault or failure due to causes beyond Our control including, but not limited to, repairs necessary due to operator negligence, improper installation, damage caused by spillage of foods/liquids, wrong usage of electrical supply and voltage, abnormal voltage, excessive heat, dust, corrosive surroundings, chemical reaction, failure to maintain the Product, failure to operate or use the Product according to instructions, accident, mishandling, misuse, tampering, vandalism, theft, fire, lightning, flood, wind, freezing, power failure, static, normal wear and tear, pests, vermin, foreign matter entering the Product, inadequate or excess power supply, unusual atmospheric conditions, or acts of war or acts of God.
- Damage, fault or failure resulting from software, virus(es), electrical wiring and connections, user facilitated minor adjustments and settings, external antenna or local reception problems, structural problems of Your premises, inaccessible Products or parts, negligence, misuse, tampering or abuse, whether wilful or not
The EYVA customer service team shall reserve to right to final decision for all potential warranty claims for service and replacement or same colour preference (depending upon stock availability).
Cancellation policy
User who had placed the initial order by paying an advance amount has the right to cancel the order on or before making the full and final payment for the Eyva.
Cancellations done before the final payment due reminder sent by the Company shall be accepted without any costs and the initial booking payment done by the user shall be refunded within 7 working days and subject to the payment gateway's refund policy.
Cancellations done on or after the final payment due reminder sent by the Company, shall be accepted without any costs and the payment done by the user shall be refunded within 7 working days and subject to the payment gateway's refund policy.
No Cancellations allowed once the order status of EYVA is reported as dispatched.
Refund policy
Company support the following payment options for purchase of EYVA:
- Credit Card
- Debit Card
- UPI
- Other Wallets
The charges that are applicable as per Razorpay. You pay only the amount that you see in your order summary at the time of check out. If you find any charges in addition to the Razorpay, Please email us at accounts@bluesemi.io
In case of a payment failure, please retry ensuring: Information passed on to payment gateway is accurate i.e. account details, billing address, password (for net banking), etc. Kindly also check if your Internet connection has been disrupted in the process.
If your account has been debited after a payment failure, it is normally rolled back to your account within 7 business days. You can email us on accounts@bluesemi.io with your order number for any clarification.
User shall receive the refund of the amount paid by them in pursuant to the Cancellation Policy above and the following terms of Refund Policy:
User shall receive the refund amount to the source Bank from where the amount has been transferred by him. However, the Company reserves the right to transfer to some other account of the User by contacting the User and collecting the information in written form.
Charges if any applicable may be withheld by the Company from the amount refundable to the User subject to the terms of these policies or terms and conditions of the Company.
Once the EYVA is dispatched from the Company, no refund shall be initiated to the User.
User hereby acknowledges that they have read these policies, terms of use and other policies and terms and conditions and should the user face any difficulty while using the device, shall reach out to the Company's technical team and shall use the device.
THESE POLICIES, IF ANY CHANGED OR ALTERED OR AMENDED, THE USER SHALL BE INFORMED THROUGH THE WEBSITE AND THE USER IS REQUESTED TO GO THROUGH THE ALTERED POLICY DOCUMENT AND THEN TAKE A DECISION.
Return policy
No Returns allowed once the order is dispatched.
Exchange policy
User shall hold the right to exchange EYVA with another device of EYVA subject to the following condition:
The product is not functional or received as damaged subject to the Company's technical team examination and identification of the device as manufacturing error or other error at the Company's end. Damages or errors at the user end shall make the user ineligible for the exchange. However, User shall be provided an extensive support from Company's technical team to resolve any issues or errors with EYVA.
User, if during the warranty period, subject to warranty policy of the Company, faces any issues with the device while using it, may send the device to the Company for testing and the Company shall, subject to validation, exchange the device or if it is reparable, repair the same device and return it to the user.
User hereby acknowledges that they have read these policies, terms of use and other policies and terms and conditions and should the user face any difficulty while using the device, shall reach out to the Company's technical team and shall use the device.
For any reparable defects that are not covered under warranty, exchange or service or support is extended by the Company at such costs as maybe applicable subject to consent of User.
Benefits & Rewards
- #ActivateHealth reward of Rs. 250 is instantly redeemed during full payment. It will be automatically redeemed upon full payment only on Eyva App.
- An additional 3 months warranty is only applicable on orders with the full amount (Rs. 16, 650) payment option via Eyva app.
- 15 months warranty implies the warranty is extended for 3 more months, in addition to the basic 12 months warranty.
- Priority dispatch is valid on orders with a full amount payment option (Rs. 16, 650) done only via the Eyva app.
- The additional profile feature of Eyva Family Care is free for 1 year.
- Eyva family care allows you to add up to 3 more user profiles in a single gadget. You can care for your whole family with a single gadget.
- Only up to 4 total profiles can be added to a single gadget. All 4 people can log in from different phones at a time.
Referral program
- A person can apply only one coupon code on a single order.
- A person who applies a referral code receives a reward of Rs.450.
- Referral gifts are won by the person who shared the referral code only when the person using the code completes the full payment.
- A person who refers wins gifts & goodies depending on the number of referrals.
- will be confirmed and dispatched after bookings are closed.
- If you refer to 1 person and they order using your code, you get a mug worth Rs.550 and that person gets a reward of Rs.450

PLEASE NOTE:
- Without a valid Proof of Purchase, EYVA reserves the rights to refuse warranty services.
- EYVA reserves the right to refuse 'free of charge' warranty claim if the information shared is incomplete/ illegible for the claim / fault in the Customer details.
- This warranty is non-transferrable. This warranty shall be the purchaser's sole remedy and neither EYVA nor its service centres shall be liable for incidental or consequential damage or breach of any expressed or implied warranty of this product.
- Repair or replacement under the terms of warranty does not provide right to extension or renewal of the warranty period.
- Warranty repairs must be carried out by EYVA authorized service centres only. Warranty cover will be void, if and when unauthorized service has been attempted by the user or any unauthorized service centre.
- EYVA may use rebuilt, reconditioned or refurbished parts and/or components when repairing or replacing a defective product.
- In case of delivery destination being unavailable, shipping charges must be handled by the buyer.
- EYVA may use your contact information to inform you about new and better products and deals in the future.
- Within/after the warranty claim requests raised by the customers; Brand has the rights to contact the customers regarding any communication about their warranty claims.
